Legal expert speaks on possible outcomes for Daesung

Since Daesung's accident regarding a motorcyclist nearly 3 weeks ago, many people and fans have become curious as to what would happen to Daesung. A legal expert has spoken up and said, "Unintentional accident is likely to end up in probation or paying a fine. He won’t be imprisoned even in the worst situation."

He continues to say that if the autopsy shows that Daesung is proven to have been responsible for Hyun's death (the motorcyclist), he will be charged with accidental homicide at best. In that case, he will be either be imprisoned for 2 years without labor or fined $7000USD.

On June 19th, MBC News Desk revealed that the National Institute of Scientific Investigation had found that Hyun had most likely been alive before Daesung hit him with his car. However, a police officer has stated that the investigation is still ongoing and that "these reports by MBC News Desk are absurd."

"The National Institute of Scientific Investigation still did not state its official position yet.”

The legal expert continues, "In this case there is no ‘intention to kill’ whatsoever. Moreover, the results of the sobriety test showed that he wasn’t drunk either, it was just an accident. Of course he is responsible for not being too careful, but looking at the previous precedent, it is unlikely to be imprisoned.”

Currently, the National Institute of Scientific Investigation (NSI) have been reported to having difficulty figuring out Hyun's cause of death. “The autopsy result usually takes about half a month for the NSI, but in this case, it’s taking almost a month. It is that hard to find out when and how someone died. If there is any doubt about the time and the cause of the death, it will be hard to accuse Daesung for accidental homicide," said a police officer.

In addition, police have also recovered a CCTV recording of the accident. However, according to reports, the CCTV recording lacks the information of cause and time of death. All in all, the only fact known is that Daesung had hit Hyun with his car on the road on Seoul Namwha Bridge, but whether he was the cause of death is still unknown.

The autopsy, which was originally slated to be done 2 weeks after the accident, has been delayed yet again due to the difficulty of finding out the cause of death. A police officer had stated that the autopsy results are expected no longer than Friday of next week.
